Partner Terms

These terms apply to tax professionals and firms ("Partner", "you") that receive client cases through FileMax Tax. By applying or using the partner dashboard you agree to them.
Eligibility
- Everyone on your account who prepares returns holds a valid IRS PTIN, and you keep your PTIN, credential, license and EFIN information current.
- You are located in the United States and prepare returns only for the states you selected.
- Representation matters (IRS letters, audits, collections) are handled only by a CPA, Enrolled Agent or attorney.
- FileMax Tax may verify your information and may decline, suspend or remove any account.
Client data
- Client information is tax return information protected by 26 U.S.C. §7216. You use it only to prepare and file that client's return and to communicate with the client about it. You never sell it, share it with anyone outside your team, or use it for marketing.
- You maintain a written information security program as required by the FTC Safeguards Rule (16 CFR Part 314), including multi-factor authentication and encryption, and you tell us within 24 hours if client data may have been exposed.
- Sub-accounts you create are your responsibility; remove access when someone leaves your firm.
- You keep records (including Form 8879 and the client's consents) for the period required by IRS rules.
Working a case
- When you take a case, it becomes exclusively yours. You contact the client within 24 hours and keep the case status up to date in the dashboard.
- You agree your fee with the client before starting and the client may decline. FileMax Tax does not set or collect your fee.
- Cases that aren't worked within the stated time may be returned to other partners.
- You are responsible for the returns you prepare and sign, including due diligence (Form 8867) where it applies. Information in a case comes from the client and must be reviewed by you before filing.
Fees
Applying is free. Partner plans and case pricing will be published in the dashboard before they apply to you, and you can decline them.
